1. Acceptance of These Terms

By accessing or purchasing any products or services (“Services”) from Transform LLC (“Transform Feng Shui,” “we,” “our,” or “us”), you (“you,” “your,” “Client,” or “User”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, please do not use our Site or Services.

2. Eligibility & Use of the Site

You must be at least 18 years old and able to form a binding contract under applicable law. You agree to use the Site only for lawful purposes and in accordance with these Terms.

3. Scope of Services

Transform Feng Shui offers virtual and on‑site feng shui consultations, reports, workshops, and related content (collectively, “Services”). All recommendations are informational, intended to enhance environmental harmony, and are not a substitute for professional legal, medical, financial, or architectural advice.

4. Ordering & Payment

  • Prices are listed in U.S. dollars.

  • Payment is due in full at checkout unless otherwise stated. Accepted payment methods are displayed at checkout.

  • Appointments are confirmed only after payment clears.

  • Pennsylvania sales tax applies where required.

5. Scheduling, Rescheduling & Cancellation

  • You may reschedule once, at least 24 hours before your appointment, subject to availability.

  • Cancellations made more than 48 hours before a scheduled appointment receive a full refund.

  • Cancellations within 48 hours or “no‑shows” forfeit 100 % of the fee.

6. Client Responsibilities

You agree to provide accurate floor plans, measurements, photos, and any other information reasonably requested. Inaccurate or incomplete information may impact the quality of the consultation and is your responsibility.

7. Intellectual Property

All content on the Site and any materials delivered during a consultation—including text, graphics, logos, audio, video, and compiled data—are the exclusive property of Transform Feng Shui or its licensors and are protected by U.S. and international intellectual‑property laws. You receive a non‑exclusive, non‑transferable license for your personal, non‑commercial use only.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TRANSFORM FENG SHUI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE CANNOT GUARANTEE THAT THE SITE, SERVICES, OR YOUR ENVIRONMENT WILL ACHIEVE ANY SPECIFIC RESULTS.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Indirect & Consequential Damages. Transform Feng Shui shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, even if advised of the possibility.

  • Aggregate Cap. Our total liability for any claim arising out of or relating to the Services or these Terms shall not exceed the greater of (i) the amount you paid to us in the 12 months preceding the event or (ii) $100.

  • Data Breaches. While we employ commercially reasonable security measures, you acknowledge that no online platform is completely secure. Transform Feng Shui shall not be liable for any damages arising from unauthorized access, hacking, data loss, or other breaches beyond our reasonable control.

10. Indemnification

You agree to defend, indemnify, and hold harmless Transform Feng Shui, its owners, employees, agents, and affiliates from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from (i) your breach of these Terms, (ii) your use or misuse of the Site or Services, or (iii) your violation of any law or third‑party rights.

11. Privacy & Data

We collect, use, and protect personal information as described in our Privacy Policy. By using the Site, you consent to such processing and warrant that all data you provide is accurate.

12. Third‑Party Links & Tools

Our Site may contain links to third‑party websites or services that are not controlled by us. We are not responsible for the content, privacy policies, or practices of any third parties, and you access them at your own risk.

13. Governing Law & Venue

These Terms and any dispute arising out of or relating to them or the Services shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict‑of‑law provisions. Any legal action must be brought exclusively in the state or federal courts located in Philadelphia County, Pennsylvania.

14. Dispute Resolution & Arbitration

At our sole discretion, we may require you to submit any disputes to final and binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association in Philadelphia, Pennsylvania. You waive any right to participate in a class action.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Continued use after any change constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is held unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.

17. Entire Agreement

These Terms, together with any policies or guidelines posted on the Site, constitute the entire agreement between you and Transform Feng Shui and supersede any prior agreements, written or oral, regarding the subject matter.
